HIPAA & HITECH COMPLIANCE

At Loop Health, we are dedicated to safeguarding your Protected Health Information (PHI) and we have implemented policies and procedures that comply with federal and state laws applicable to us as a healthcare provider. We comply with the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the Health Information Technology for Economic and Clinical Health Act (HITECH).

HIPAA Compliance

HIPAA sets the standard for protecting sensitive patient data. Any company that deals with PHI must ensure that all the required physical, network, and process security measures are in place and followed. This includes covered entities (CE), anyone who provides treatment, payment, and operations in healthcare, and business associates (BA), anyone with access to patient information and provides support in treatment, payment, or operations.

HITECH Compliance

The HITECH Act, enacted as part of the American Recovery and Reinvestment Act of 2009, was signed into law on February 17, 2009, to promote the adoption and meaningful use of health information technology. It addresses the privacy and security concerns associated with the electronic transmission of health information, in part, through several provisions that strengthen the civil and criminal enforcement of the HIPAA rules.

Enforcement and Penalties

The HITECH Act of 2009 strengthened the civil and criminal enforcement of HIPAA rules. It introduced “violation tiers” with increased financial penalties, making it more costly for Covered Entities to pay the fines rather than becoming HIPAA compliant. The increased value of the fines gave the Office for Civil Rights (OCR) more resources to pursue non-compliant Covered Entities and enforce HIPAA.
